NA KOA LANI CANOE CLUB Adult and Minor Waiver, Agreement and Release of Liability January 1, 2025 to December 31, 2025 In consideration of being allowed to participate in any way in the Na Koa Lani Outrigger Canoe Club and its practices, races, and related events and activities, the undersigned: Agrees that prior to participating, they each will inspect the facilities and equipment to be used, and if they believe anything is unsafe, they will immediately advise their coach or supervisor of such condition(s) and refuse to participate. Acknowledges and fully understands that each participant will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses which might result not only from their own actions, inactions or negligence, but the action, inaction or negligence of others, the rules of play, or the condition of the premises or of any equipment used. Further, that there may be other risks not known to us or not reasonably foreseeable at this time. Assumes all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability or death. Releases, waives, discharges and covenants not to sue the Na Koa Lani Outrigger Canoe Club, its administrators, directors, agents, coaches, and other volunteers or employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used to conduct the event, all of which are hereinafter referred to as Releasees, from demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasee or otherwise. Agrees to assume all responsibility for my /minor participant's medical and dental care while involved in the activities of Na Koa Lani Outrigger Canoe Club. Understands that participating in practices, races, or any other club activity will be at my own risk. Agrees to practice good sportsmanship, conduct myself respectably at club functions, and respect and care for all club equipment. By signing this waiver and release without a parent’s or guardian’s signature, the participant represents he/she is at least 18 years of age, or, if signing as the parent or guardian of the participant, signer represents they are the custodial parent or legal guardian of the minor participant. The undersigned custodial parent or legal guardian acknowledges that he/she is also signing this release on behalf of the minor participant, that he/she is waiving certain rights on behalf of the minor participant that the minor participant otherwise may have and that the minor participant shall be bound by all of the terms of this release.THE UNDERSIGNED HAVING READ THE ABOVE WAIVER AND RELEASE, UNDERSTANDS THAT THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS AND SIGN VOLUNTARILY BELOW.

Hold Harmless, Waiver of Liability and Indemnity Agreement January 1, 2025 to December 31, 2025 For and in consideration of permission granted by the United States Marine Corps for me and /or my child or ward to enter Marine Corps Base (MCB) Hawaii, Kaneohe Bay, Hawaii, during 2025, to attend and/or participate in the Na Koa Lani Canoe Club, and being informed of all the activities that I and/or my child or ward will engage in during this period of time, to include, but not limited to, all natural environments, transportation on and off the installation, social events, and activities, I forever discharge and hold harmless the United States, United States Marine Corps, and all of its officers and personnel, employees, representatives, and their successors or assigns, including the Commanding Officer, MCB Hawaii, Kaneohe, Hawaii, from any and all liability under the Federal Tort Claims Act (28 U.S.C. Sections 1346(b) and 2671-2680), or other statutes addressing personal injury or property losses. I also waive all claims, demands, damages, actions or suits of any nature or legal basis against the United States of America, United States Marine Corps, and their agencies, departments, officers, employees, personnel and their successors or assigns, including the Commanding Officer, MCB Hawaii, arising from any injury or alleged injury, including death, and property damage or loss that occurs incident to my entering upon, engaging in any activities during Na Koa Lani paddling, including but not limited to, engaging in physical activities, transportation on and off the installation, and/or use of any facility or equipment located on MCB Hawaii, wherever the loss or injury may occur. I also understand that if I have, or am the custodian of a student or minor child, and choose to allow them to attend and/or participate in the subject events, that the same risks and considerations detailed above also apply to them. I understand that no special measures have been taken to specifically address the needs, tendencies, and care of the students or minor children, nor will special supervision or guidance be available to them by members of MCB Hawaii during this event. Therefore I fully appreciate the special risks to the students and/or minor children in my custody and understand that I am solely responsible for their actions and care. I understand that this waiver is legally binding on me and my heirs, executors, and administrators. I also acknowledge that I am aware of the risks involved in my and or my son's/daughter's/ward's attendance and/or participation in the Na Koa Lani Canoe Club visit. Further acknowledge that I have carefully read this release, understand the contents thereof, and sign this release as my free and voluntary act.
