Hawaiian Canoe Racing Association Insurance Program Adult and Minor Waiver and Release of Liability January 1, 2025 to December 31, 2025 In consideration of being allowed to participate in any way in the Hawaiian Canoe Racing Association and its member organizations’ athletics/sports programs, and related events and activities, the undersigned: 1. Agree that prior to participating, they each will inspect the facilities and equipment to be used, and if they believe anything is unsafe, they will immediately advise their coach or supervisor of such condition(s) and refuse to participate. 2. Acknowledge and fully understand that each participant will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses which might result not only from their own actions, inactions or negligence, but the action, inaction or negligence of others, the rules of play, or the condition of the premises or of any equipment used.Further, that there may be other risks not known to us or not reasonably foreseeable at this time. 3. Assume all the foregoing risks and accept personal responsibility for the damages following such injury,permanent disability or death. 4. Release, waive, discharge and covenant not to sue the Hawaiian Canoe Racing Association, its member associations, its affiliated clubs, their respective administrators, directors, agents, coaches, and other volunteers or employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used to conduct the event, all of which are hereinafter referred to as “releasees”, from demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasee or otherwise. The undersigned custodial parent or legal guardian acknowledges that he/she is also signing this release on behalf of the minor participant, that he/she is waiving certain rights on behalf of the minor participant that the minor participant otherwise may have and that the minor participant shall be bound by all of the terms of this release. By signing this waiver and release without a parent’s or guardian’s signature, the participant represents he/she is at least 18 years of age, or, if signing as the parent or guardian of the participant, signer represents they are the custodial parent or legal guardian of the minor participant. THE UNDERSIGNED HAVING READ THE ABOVE WAIVER AND RELEASE, UNDERSTAND THAT THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND SIGN IT VOLUNTARILY
I acknowledge and fully understand that participation in club activities, events, races, practices, programs, or any activity (hereinafter Activities) is an inherently dangerous activity which involves risk of serious injury, including permanent disability, death, or other losses. Risk may arise from any number of circumstances including, but not limited to, the actions or inactions of the participant or other persons, the rules of play, the condition of the premises or equipment. Risk, whether known or unknown, reasonably forseeable or not, are inherent in paddling and Activities. I understand and assume the risks. I accept personal responsibility and assume the liability for any damages incurred associated with the risks of participation. I release, waive, discharge and covenant not to sue the Canoe Club, their respective administrators, directors, agents, coaches, and other volunteers or employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used during participation, (hereinafter Club). I assume all risks associated with losses or damages arising from my participation in Activities, whether due to Club negligence or otherwise. Photo/Media Release: Club hereby has my permission to photograph, film, or otherwise record and use images that may include myself and/or my child/children, voice, and/or likeness, for limited, educational & nonprofit purposes. Children's names are never used. Additionally, Club will reach out to get specific permission for any specific, planned use. I understand that paddling is a public sport in a public place, and the club has no control over other Club members, members of the public, or volunteers who may take photos and use personally. Volunteerism: I recognize that the amount paid for annual membership dues is not nearly enough to cover the annual expenses of the Club. I understand that every year a lot of additional funds must be raised by the members for the Club to survive. I agree that as part of club membership I am required to actively participate in Club Fundraising and other Club events. I promise to do so, especially when it is specifically requested by Club officers. Physical Fitness: I hereby give my permission and consent to engage in the activities of the Club as described above. To my knowledge, no reason exists to suggest I/they are physically unable to compete in supervised canoe paddling. I also give my consent for the above to accompany the Club as a member to the various practices and race sites designated by the Club. A physician may treat the above paddler whenever necessary until other arrangements can be made, and the coach(es), officers(s), agent(s) and/or member(s) of the Club may render first aid if he/she/they are qualified to do so. NOTE THAT NAMOLOKAMA O`HANALEI CANOE CLUB reserves the right to deny participation to those whose financial responsibilities are not met or for reasons including, but not limited to: (a) any conduct that brings the Club into disrepute publicly or within the Hawalian canoeing community or violates the purposes for which the Club is formed; (b) any willful failure or refusal to abide by the Bylaws or Rules of the Club or the Membership Agreement, or (c) any persistent conduct which results in serious interference with the ability of the Club and its general membership to function in a harmonious manner.Dues are nonrefundable and non transferable. THE UNDERSIGNED, HAVING READ THE ABOVE WAIVER AND RELEASE and TERMS OF THE AGREEMENTS UNDERSTANDS THAT THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING, AND SIGN VOLUNTARILY.
