Adult and Minor Waiver and Release of Liability
January 1, 2025 to December 31, 2025
In consideration of being allowed to participate in any way in the Hawaiian Canoe Racing Association and its member organizations’ athletics/sports programs, and related events and activities, the undersigned:
1. Agree that prior to participating, they each will inspect the facilities and equipment to be used, and if they believe anything is unsafe, they will immediately advise their coach or supervisor of such condition(s) and refuse to participate.
2. Acknowledge and fully understand that each participant will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses which might result not only from their own actions, inactions or negligence, but the action, inaction or negligence of others, the rules of play, or the condition of the premises or of any equipment used.Further, that there may be other risks not known to us or not reasonably foreseeable at this time.
3. Assume all the foregoing risks and accept personal responsibility for the damages following such injury,permanent disability or death.
4. Release, waive, discharge and covenant not to sue the Hawaiian Canoe Racing Association, its member associations, its affiliated clubs, their respective administrators, directors, agents, coaches, and other volunteers or employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used to conduct the event, all of which are hereinafter referred to as “releasees”, from demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasee or otherwise.
The undersigned custodial parent or legal guardian acknowledges that he/she is also signing this release on behalf of the minor participant, that he/she is waiving certain rights on behalf of the minor participant that the minor participant otherwise may have and that the minor participant shall be bound by all of the terms of this release. By signing this waiver and release without a parent’s or guardian’s signature, the participant represents he/she is at least 18 years of age, or, if signing as the parent or guardian of the participant, signer represents they are the custodial parent or legal guardian of the minor participant.

OHCRA Release of Liability
In consideration of being allowed to participate in sports, recreational, and related events of any kind, the undersigned releases from liability the Oahu Hawaiian Canoe Racing Association and its member organizations, affiliated clubs, their administrators, directors, agents, coaches,volunteers or employees, other participants,sponsoring agencies, sponsors, advertisers, and owners and leasees of premises where activities or events are conducted, hereinafter referred to as “Releasees,” in full understanding and agreement that:
1. Paddling and other club activities are inherently dangerous, involving risk of serious injury, including permanent disability and death, and severe social and economic losses which might result from the actions, inactions or negligence of their own or of others, the rules of play, or the condition of the premises or of any equipment used. Risks may be unknown, and not reasonably foreseeable.
2. Prior to participating, it is paddler's responsibility to inspect the facilities and equipment to be used, and if they believe anything is unsafe, to immediately advise their coach or supervisor of such condition(s) and refrain from participating. Paddlers will follow all rules and instructions relating to conduct and safety.
3. They understand and assume all risk associated with participating, and release, waive and discharge Releasees from liability for demands, losses or damages on account of injury, including death or damage to property related to participation.
4. Paddling and other club activities are inherently public, taking place on beaches, open water and other locations open to the public. Photographs may be taken by Releasees or by members of the public. I hereby grant Releasees the right to use paddler's photograph or recording in any and all forms of media and in all manners including, but not limited to edited, or composite media formats, for the purpose of documenting the perpetuation of the art of the sport of Hawaiian Outrigger Canoe training, rigging, paddling and racing; for news release, art, advertising, trade or any other lawful purpose whatsoever; and release, discharge, and agree to save Releasees from any liability by virtue of blurring, distortion, or alteration whether intentional or otherwise, that may occur or be produced in the making of said images.
The undersigned custodial parent or legal guardian acknowledges that he/she is also signing this release on behalf of the minor participant, that he/she is waiving certain rights on behalf of the minor participant that the minor participant otherwise may have and that the minor participant shall be bound by all of the terms of this release. I understand that my membership is conditioned upon agreeing to all terms of this agreement. Violations may affect membership standing in OHCRA and/or Hui Nalu Canoe Club.

*Providing ocean oriented education programs special to Hawai'i;
*Providing other sport activities programs and opportunities;

*Preserving Hawaiian traditions as they relate to the ocean, family, and community;
*Supporting club members to achieve their athletic potential;
*Nurturing club spirit and personal pride.
DUES:
*I understand that my dues are due at the time of I start paddling. A partial dues refund may be requested no later than May 31st. Dues are non-refundable starting June 1st. Dues are non-transferable.
*I understand that my dues provide use of equipment, registration & race fees in OCHRA, insurance through HCRA, club shirt and decal, events, insurance for our canoes, equipment maintenance and repairs, transportation of canoes to and from the race sites, general administration fees, new equipment as needed, misc. expenses associated with regatta races, and misc. expenses associated with club operations. Hui Nalu Canoe Club is a volunteer run organization with no paid staff.
NO ALCOHOL POLICY: It is against State law and City and County of Honolulu regulations to drink alcoholic beverages at any public parks and beaches. Violations of these rules are unacceptable and the Hui Nalu Board will take action. If any Hui Nalu member, or their family member or friend, is found to be drinking alcoholic beverages that club member will be responsible for paying whatever fine is imposed on the club.
NEWS and VOLUNTEERING: I understand that I need to stay up to date with HN activities and that our website is the first place to look. I agree to receive email communications from Hui Nalu.
*I understand I must participate in crew assignments as requested throughout the year.
*I understand that I must volunteer for HN activities sponsored by Hui Nalu. This includes social events for paddlers. Hui Nalu sponsors the Kala Kukea pre-season race and Kaupiko regatta. Volunteer help is needed for both events. Hui Nalu’s fundraiser is the Kaiwi Coast Run & Walk. Many hands are needed to put on this 4-mile event for 3,000 participants. Volunteers are needed for packet pickups, the day before and day of the event. The Kaiwi Coast Run & Walk is the Sunday before Thanksgiving every year. Mark your calendars.
*Parents of youth are expected to volunteer for their children.
*I understand that activities of Hui Nalu may be suspended or rescheduled due to circumstances outside of our control.
CODE OF ETHICS and OHCRA Race Rules: We are all responsible to promote good sportsmanship and fair play in the activities in which we engage. This means observance of these race rules as well as generally accepted rules of behavior and all governmental laws.
Paddlers are required to avoid situations where a canoe is deliberately rammed, where there is deliberate interference with another crew, and situations where assaults and abusive language are used.
*Coaches are required to support and help enforce these race rules and avoid any circumvention of these rules.
*Officials and officers are required to do their best to be fair and not be biased in their decisions and carrying out their duties.
*Any club members that are found drinking at our events will result in the entire club being asked to leave the event and no longer being allowed to compete for that day's events. This includes all paddlers, friends, and family.
CODE OF CONDUCT from Hui Nalu By-laws and posted on its website provides that we maintain an atmosphere of caring and respect at all Club practices and functions by its members and their families. The following will be considered a violation of our Code of Conduct as summarized here:
*Any form of discrimination;
*Any form of bullying;
*Any form of sexual misconduct;
*Any use of illegal drugs, abuse of alcohol;
*Any excessive profanity;
*Any obscene language, gesture or threatening or physical violence toward anyone;
*Any drinking alcohol during a regatta, distance or preseason race;
*Any act of fraud, deception or dishonesty in connection with any club activity.
Members of the Hui Nalu may be placed on probation, suspended or expelled for violations.
Photo/Media Release: Hui Nalu Canoe Club hereby has my permission to photograph, film, or otherwise record and use images that may include myself and/or my child/children, voice, and/or likeness, for educational purposes and on limited occasion, for publicizing or promoting HNCC and/or activities. Children's names are never provided or tagged. We do not publish names of adults or tag adults in any official club publications without obtaining permission from the adult.

I understand that paddling is a public sport in a public place, and the club has no control over other club members, members of the public, or volunteers who may take photos and use personally.
Assumption of All Risk:
I assume all risks associated with losses or damages arising from my participation in Hui Nalu Activities, whether due to HNCC Parties negligence or otherwise.
I, the undersigned, am the applicant named above, aged 18 or older, or am the Legal Parent/Guardian of the minor child applying for membership named above. My (or my minor child's) participation in Hui Nalu events, programs, or activities of any kind, are conditioned upon my agreement to uphold all club rules as found in the operations manual, code of ethics, code of conduct, safety or other directions from coaches, and all above terms of this agreement.
